All services are provided according to the details outlined in your accepted quotation, proposal, or contract.

 

3. Project Process and Delivery

Projects begin once an initial payment or full amount (as stated in your invoice) has been received.
Delivery timelines depend on project size, client feedback, and the timely supply of required materials (e.g., text, logos, images, access credentials).

Delays caused by the client, including late feedback or missing materials, may result in project timeline extensions.

 

4. Payments

  • Payments may be once-off (per project) or monthly (for hosting or maintenance), as agreed upon in writing.

  • All prices are in South African Rand (ZAR).

  • Work will only begin once the required Payment has been received.

  • Full payment must be made before website handover or publication.

Monthly Hosting Payments

  • Hosting payments are due monthly in advance.

  • Late payments may result in website suspension until payment is received.

  • SiteSphere ZA is not responsible for any downtime, data loss, or SEO ranking loss caused by non-payment or account suspension.

 

5. Refund Policy

All payments are non-refundable once work has started or hosting has been activated.
Refunds are not available for change-of-mind cancellations, delays caused by the client, or dissatisfaction resulting from unclear or incomplete instructions.

 

6. Ownership and Intellectual Property

  • Once the project has been fully paid, ownership of the completed website design and content transfers to the client.

  • Hosting accounts, source files, and domain names remain under SiteSphere ZA’s management unless otherwise agreed in writing.

  • SiteSphere ZA reserves the right to display completed projects in its portfolio or marketing materials.

 

7. Client Responsibilities

Clients are responsible for:

  • Providing accurate and timely information needed to complete the project.

  • Supplying licensed content (e.g., images, fonts, and text).

  • Maintaining confidentiality of their account credentials.

SiteSphere ZA will not be held liable for errors, losses, or delays caused by incomplete or incorrect information supplied by the client.

 

8. Website Hosting Terms

  • Hosting services are provided on a month-to-month basis unless otherwise stated.

  • SiteSphere ZA will make reasonable efforts to maintain uptime and data security, but uninterrupted service cannot be guaranteed.

  • The client is responsible for keeping backups of their website content.

We reserve the right to suspend or terminate hosting services if payment is overdue or if the website violates South African law or our acceptable use policy.

 

9. Limitation of Liability

While we take every reasonable precaution to ensure the reliability of our services, SiteSphere ZA will not be liable for:

  • Any direct, indirect, or consequential loss resulting from the use or inability to use our services;

  • Loss of data, profits, or business opportunities;

  • Errors or interruptions caused by third-party services (such as domain registrars, hosting providers, or email systems).

All services are provided “as is” and at the client’s own risk.

 

10. Third-Party Services

We may use or recommend third-party services (such as hosting providers, payment gateways, or plugins).
SiteSphere ZA is not responsible for any issues, downtime, or data breaches caused by these third parties.

 

11. Termination of Services

Either party may terminate ongoing services (e.g., hosting or maintenance) by giving 30 days’ written notice.
All outstanding payments must be settled before termination.
We reserve the right to immediately terminate service if a client breaches these Terms or uses our services for unlawful purposes.

 

12. Privacy

Your personal and business information will be handled according to our Privacy Policy, which outlines how data is collected, stored, and used.

 

13. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any disputes arising under these Terms shall be resolved in South African courts with appropriate jurisdiction.

 

14. Changes to These Terms

We may update these Terms and Conditions at any time without prior notice.
Updates will be effective immediately upon posting on our website. Continued use of our services implies acceptance of any revised terms.
